Opening Arguments Begin In Eastwood Trial

The suit had prompted Eastwood to join a campaign to require people with disabilities to notify a business owner that they had violated the Americans with Disabilities Act 90 days prior to filing a complaint. Eastwood told the U.S. House Committee on the Judiciary that “renegade” lawyers were taking advantage of people with disabilities by profiting from bogus ADA claims.
Does my facility have to comply?

While in theory, some very small facilities are exempt, virtually all public and private facilities must comply with the federal ADA laws. This includes corporate facilities, hotels, hospitals, schools, theaters and sporting venues. Churches, synagogues, and in some cases private clubs are exempt. We, of course, will make sure that you are in compliance with ADA as it relates to signage.

Do all signs in the building have to comply with ADA?

Yes, all signs must comply as to their location on the wall. However, only signage relating to “Permanent Room Identification” is required to have raised copy and Braille.

No, only signage relating to “Permanent Room Identification” is required to have raised copy and Braille. This excludes directories, directionals and general informational signage such as, no smoking and office hours. Names and titles also do not have to have raised copy and Braille.

What if the sign cannot be positioned on the latch side of the door 60″H to sign center per ADA regulation?

There is a “Reasonable Efforts” standard, so installation at alternate locations is permissible. Installation on the door, however, should be avoided.
